This Privacy Policy is agreed upon and accepted by the User.

Your privacy is important to The Golf App, and ManagerApp company. This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal data and information when You use the Service and tells You about Your privacy rights and how the law protects You.

We use Your personal data to provide and improve the Service. By using the Service, You agree to the collection and use of Your data and information in accordance with this Privacy Policy.

This Privacy policy applies to the website  https://thegolfapp.com/ and the mobile application The Golf App [TGA] available in App Store, Google Play and Huawei.

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

Account means a unique account created for You to access our Service or parts of our Service.

Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authorities.

Application or TGA means the software program provided by the Company downloaded by You on any electronic device, named The Golf App.

Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to the legal entity ManagerApp d.o.o., Dunajska cesta 119, Ljubljana, SI-1000, Slovenia.

Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

Country refers to: Slovenia.

Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.

Data Protection Laws and Regulations refers to all laws and regulations, including laws and binding regulations of the European Economic Area, applicable to the Processing of Personal Data under the Agreement.

Device means any device that can access the Service such as a computer, a cell phone, digital tablet or and smartwatch.

Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.

The Golf App is a mobile app that offers various features, referred as Service, such as booking tee times, sharing reservations, keeping score, receiving statistics and much more. The app also includes course information, flight videos, course rules, weather cameras and a history of games played.

GDPR refers to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Text with EEA relevance).

Personal Data is any information that relates to an identified or identifiable individual. For the purposes for GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.

Processing means any operation or set of operations which is performed upon Personal Data, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Service refers to the Application or the Website or both.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

Third-party Login Service refers to service of Google lcc or Apple inc or Facebook inc through which a User can log in and create an account to use the Service.

Usage of data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

User is an individual or business that uses the Service.

Website refers to The Golf App website, accessible from https://www.thegolfapp.com/

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Who is responsible for the processing of Your personal data?

Your personal data is collected, stored and otherwise processed by the Company ManagerApp d.o.o., with its registered office at Dunajska cesta 119, Ljubljana, SI-1000, Slovenia as the Data Controller.

What Types of Data do We collect and process?

Personal Data

The data You provide through the mobile booking application is used to create Your User Account.

Personally identifiable information processed for this purpose:

  • Email address
  • First name and last name

This processing is justified by the pre-contractual relationship resulting from your request.

Further on, based on Your Request and further Consent, We share Your data with Golf locations as the Service Providers for the use of the effective and correct implementation of reservations. Access to such information is granted to authorized personnel who manage and supervise reservations. Personally identifiable information, that You voluntary enter into Your Profile in Your User Account in the EGA, processed for this purpose:

  • Email address
  • First name and last name
  • Phone number
  • Postal Address

Use of your booking/application code

You may receive by electronic communication, such as a mobile application’s push notifications, the following communications:

  • TGA App information: updates or informative communications related to the functionalities, products, news, special offers or contracted services.
  • Golf location information: news, updates, weather notifications regarding your booking ect.
  • Flight: communications will not be communicated with created Accounts but with the booking code and will be visible to all who are pared to the corresponding bookings. The User Account information and booking data are not directly linked, they are connected.

Usage Data

Usage Data is collected automatically when using the Service.

When You access the app We may collect certain information automatically, including the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data that do not reveal your identity. We may also collect information that Your browser sends whenever You visit our website or when You access the Service by or through a mobile device.  This information is used to offer You better user experience.

Information Collected while Using the Application

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:

  • Information regarding Your geolocation which is displayed only to present accurate distance to the hole and is not recorded.
  • Pictures and other information from your Device’s camera and photo library together with the GPS location of the damage for the purpose to report potential damage at the Golf location.

We use this information to provide core features of Our Service. The information may be uploaded to the TGA servers and/or or it be simply stored on Your device. You can enable or disable access to this information at any time, through Your Device settings.

Payments

We may provide paid products and/or services within the Service. In that case, we may use third-party services for payment processing (e.g. payment processors).

We will not store or collect Your payment card details. That information is provided directly to Our third-party payment processors whose use of Your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

What is  Your personal data used for?The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including monitoring the usage of our Service. This processing is justified by the fulfilment of the agreement you have entered into with Us by accepting the Terms and Conditions of the TGA mobile application.
  • To manage Your Account: to manage Your registration as a User of the Service if you choose manual registration of the account instead of Third-Party Login service (e.g. Google, Apple). The personal data You provide can give You access to different functionalities of the Service that are available to You as a registered User. This processing is justified by the fulfilment of the agreement you have entered into with Us.
  • To manage Your requests or complaints: To attend and manage Your requests to Us. This processing is based on Our legal obligations (e.g. manage your Data Subject Requests) or based on Our legitimate interests (prevention of legal action).

We may share your personal information in the following situations:

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, for payment processing.
  • With Affiliates: We may share Your information with Our Affiliates, in which case we will require those Affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With other Users on your booking: when you connect with others on your Golf booking your first and last name will be displayed.

How long is  Your personal data stored?

The Company will retain Your personal data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your personal data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Who has access to  Your personal data?

We only share Your personal data with those who are duly authorised for their functions and tasks to process Your personal data. For all of this data sharing, we ensure that we only work with trusted companies and secure these relationships.

In some cases, we may share Your personal data with partners, who will use it for their own purposes. In such a case, these partners shall act as data controllers and their personal data processing policy shall apply to the data shared. We make sure to ask you for your consent to this sharing when required by the regulations, or at least to enable you to object.

How is Your personal data kept secured

Your personal data is stored on secure servers. We put in place, and require from our processors and partners, appropriate data security and data protection measures in line with the latest technologies.

When Your Account is created, entering a password that respects Our security standards is mandatory and is part of Our Privacy Policy. It is Your responsibility to keep it secret.

We do not sell personal information. However, the Service Providers we partner with (for example, our advertising partners) may use technology on the Service that “sells” personal information.
